Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or self-employed professional activity.)

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day:

  • on which you, or a third party other than the carrier and indicated by you, acquire(s) physical possession of the goods, where you ordered one or more goods in a single order and they are delivered together;
  • on which you, or a third party other than the carrier and indicated by you, acquire(s) physical possession of the last good, where you ordered several goods in a single order that are delivered separately;
  • on which you, or a third party other than the carrier and indicated by you, acquire(s) physical possession of the last lot or piece, where you ordered a good that is delivered in several lots or pieces.

To exercise your right of withdrawal, you must inform us (mediparts GmbH, Hünenbergstraße 157, 46147 Oberhausen, telephone: 0208/3849120, e-mail: webshop@meddax24.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form, but this is not obligatory.

You may also exercise your right of withdrawal online, via a correspondingly labelled button ("Withdraw from contract" or similar) on our website (meddax24.de). If you use this online function, we will send you, on a durable medium (e.g. by e-mail), confirmation of receipt of the withdrawal without undue delay, including information on the content of the withdrawal declaration as well as the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. For this reimbursement, we will use the same means of payment that you used for the initial transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earlier.

You shall send back the goods or hand them over to us without undue delay and in any event no later than 14 days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of 14 days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than that which is necessary to establish the nature, characteristics, and functioning of the goods.

Grounds for exclusion or lapse

The right of withdrawal does not apply to contracts:

  • for the supply of goods that are not prefabricated and for the production of which an individual choice or determination by the consumer is decisive, or that are clearly tailored to the consumer's personal requirements;
  • for the supply of goods that are liable to deteriorate or expire rapidly;
  • for the supply of alcoholic beverages, the price of which was agreed at the time of conclusion of the contract but which can be delivered no earlier than 30 days after conclusion of the contract, and whose current value depends on fluctuations in the market over which the trader has no control;
  • for the supply of newspapers, periodicals, or magazines, with the exception of subscription contracts.

The right of withdrawal lapses early in the case of contracts:

  • for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene, where their seal was removed after delivery;
  • for the supply of goods that, after delivery, were inseparably mixed with other items due to their nature;
  • for the supply of sealed audio or video recordings or sealed computer software, where the seal was removed after delivery.
